The following sectors are AIs and\nRIs: capital markets, collective investment\nschemes, micro lenders and insurers.\n<br><br>\nIn terms of sec 35 (2) of FIA, NAMFISA supervises,\nmonitors and enforces compliance by AIs and RIs with\nFIA. Any reference to FIA in this article shall include\nall subordinate legislations such as regulations, orders,\ncirculars, notices, determinations and directives issued\nunder FIA.\nThis article discusses the consequences that AI\u2019s and RI\u2019s\nface if they fail to comply with FIA and the international\nstandards. For purposes of this article, the AIs and RIs will\nbe jointly referred to as the financial institutions.\nInternational framework\n\n<\/div><!-- .section-description --><\/div><!-- .section-title-wrapper -->\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a76e01 elementor-widget elementor-widget-egovenzsectiontitle\" data-id=\"1a76e01\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"egovenzsectiontitle.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"section-title-wrapper border-light text-left\"><div class=\"title-wrap\"><h5 class=\"section-title\">Why Compliance Matters<\/h5><\/div><!-- .title-wrap --><div class=\"section-description\">The Financial Action Task Force (FATF) recommends strong, fair penalties for institutions and their management that fail to comply with AML\/CFT\/CPF laws. These requirements include KYC (Know Your Customer) checks, monitoring of transactions, and reporting of suspicious or large cash transactions.\n\nFailure to comply can:<\/div><!-- .section-description --><\/div><!-- .section-title-wrapper -->\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6fe9d3d elementor-widget elementor-widget-egovenziconlist\" data-id=\"6fe9d3d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"egovenziconlist.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"icon-list-wrapper\"><ul class=\"nav flex-column vertical-icon-list\"><li class=\"icon-parent\"><span class=\" icon-theme-color ti-minus\"><\/span>Result in heavy penalties<\/li><li class=\"icon-parent\"><span class=\" icon-theme-color ti-minus\"><\/span>Damage Namibia\u2019s international reputation<\/li><li class=\"icon-parent\"><span class=\" icon-theme-color ti-minus\"><\/span>Reduce investor confidence and harm the economy<\/li><\/ul><\/div><!-- .icon-list-wrapper -->\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-003e22e elementor-widget elementor-widget-egovenzsectiontitle\" data-id=\"003e22e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"egovenzsectiontitle.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"section-title-wrapper border-light text-left\"><div class=\"title-wrap\"><h3 class=\"section-title\"><\/h3><span class=\"title-separator separator-border theme-color-bg\"><\/span><\/div><!-- .title-wrap --><div class=\"section-description\"><span class=\"lead d-block\">Types of Offences under the FIA<\/span>Offences are grouped into five categories:\n<br><br>\n1. Administrative \u2013 Failure in client identification, risk assessment, due diligence, etc.<br>\n\n2. Records \u2013 Tampering with or failing to keep\/access required records.<br>\n\n3. Reporting \u2013 Not reporting large or suspicious transactions.<br>\n\n4. Disclosure \u2013 Tipping off or misusing confidential information.<br>\n\n5. Directives \u2013 Ignoring directives or obstructing NAMFISA officials.<br>\n\n<br>\nPenalties can include up to N$100 million in fines or 30 years in prison, or both.\n<br><br>\nFailure to submit compliance reports to NAMFISA can also result in up to N$10 million fine or 10 years imprisonment. Penalties may also apply to NAMFISA itself if it fails in its supervisory duties.<\/div><!-- .section-description --><\/div><!-- .section-title-wrapper -->\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cf511c1 elementor-widget elementor-widget-egovenzsectiontitle\" data-id=\"cf511c1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"egovenzsectiontitle.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"section-title-wrapper border-light text-left\"><div class=\"title-wrap\"><h3 class=\"section-title\">5 Types of Offences Expanded Upon<\/h3><span class=\"title-separator separator-border theme-color-bg\"><\/span><\/div><!-- .title-wrap --><div class=\"section-description\">(i)Administrative related: these are offences related\nto the identification of clients, procedures to follow\nwhen dealing with clients identified as high risk\nclients, on going and enhanced due diligence, cross\nborder correspondent transactions, the conduct of risk\nassessments and the formulation and implementation\nof internal rules to combat AML\/CFT\/CPF.\n<br><br>\n(ii)Records related: these are offences related to the\ndestruction or tampering of any records kept; record keeping;\nfailure to give assistance to the Financial Intelligence\nCentre (\u201cFIC\u201d) to access the records kept; failure to declare\ncross border movement of cash and bearer negotiable\ninstruments above the prescribed limits; and failure to\nelectronically register declared cross border movement of\ncash and bearer negotiable instruments\n<br><br>(iii)Reporting related: these are offences related to\nreporting cash transactions above prescribed limits, reporting\nsuspicious or unusual transactions to the FIC;\nand reporting of conveyance of cash in excess to the\nprescribed limits into or out of Namibia.\n<br><br>\n(iv)Disclosure related: these are offences related to\ntipping off; misusing and disclosure of confidential\ninformation.\n<br><br>\n(v)Directives \/ order related: these are offences related\nto failure to comply with a directive, monitoring\norder, obstruction hindrance or threatening NAMFISA\nofficials or agents in performance of their functions.\nIn addition, failure by financial institutions to submit\nrequested reports to NAMFISA regarding the\ninstitution\u2019s compliance with FIA is a criminal offence,\nif found guilty, a fine of up to N$10 million or 10 years\nimprisonment, or both the fine and the imprisonment\nmay be imposed.\n<\/div><!-- .section-description --><\/div><!-- .section-title-wrapper -->\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0115b55 elementor-widget elementor-widget-egovenzsectiontitle\" data-id=\"0115b55\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"egovenzsectiontitle.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"section-title-wrapper border-light text-left\"><div class=\"title-wrap\"><h3 class=\"section-title\">Penalties<\/h3><span class=\"title-separator separator-border theme-color-bg\"><\/span><\/div><!-- .title-wrap --><div class=\"section-description\">It should be noted that penalties under FIA are not\nonly limited to persons responsible for such financial\ninstitutions but also applicable to supervisory bodies\nlike NAMFISA in the event they fail to execute their\n\nmandate. A administrative fine not exceeding N$10\nmillion or imprisonment term of not more than 10\nyears may be imposed on the supervisory body.\n<br>\n<br>\n<h5>Alternative measures before\nimposition of penalties\nBefore resorting to criminal action NAMFISA may\nexplore other alternatives to ensure compliance with\nFIA. FIA makes provision for the following alternative\ncompliance enforcement measures:<\/h5>\n<br><br>\n1. Directives\nHere NAMFISA directs the institution\/s involved to provide\ncertain information \/ documents or reports; cease or\nrefrain from specified omission or commission which\ncontravenes FIA; take correction action; or perform acts\nnecessary to meet obligations imposed by FIA.\n<br><br>\n2. Administrative penalties\nNAMFISA may, after consulting the FIC impose one\nor more of the following administrative penalties on\ninstitution or person namely: <br>(i) a caution not to repeat the;<br>\n(ii) a formal expression of disapproval, <br>(iii) a directive to\ntake corrective action or make specific arrangements; <br>(iv)\nthe restriction or suspension of certain identified business\nactivities; <br>(v) suspension of licence to carry on business;\nor <br>(vi) a financial penalty not exceeding N$10 million.\n<br><br>\n3. Application to court\nNAMFISA may institute legal proceedings against a\nfinancial institution or a person, after consulting the\nFIC, to: <br>(i) discharge any obligations imposed by the\nFIC or supervisory body; <br>(ii) compel the institution or\nperson to comply with FIA; <br>(iii) cease contravening FIA;\n<br>(iv) compel the institution or person to comply with a directive;\nor <br>(v) obtain declaratory order on any point of law\nrelating to FIA.<\/div><!-- .section-description --><\/div><!-- .section-title-wrapper -->\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e28f2c1 elementor-widget elementor-widget-egovenzsectiontitle\" data-id=\"e28f2c1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"egovenzsectiontitle.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"section-title-wrapper border-light text-left\"><div class=\"title-wrap\"><h3 class=\"section-title\">Conclusion<\/h3><span class=\"title-separator separator-border theme-color-bg\"><\/span><\/div><!-- .title-wrap --><div class=\"section-description\">\nIn conclusion, non-compliance with the provisions of\nFIA by financial institutions or persons in control of\nsuch institutions can lead to a damaged national reputation,\nthreaten the good functioning of our financial system\nand dampen foreign direct investment. Compliance with\nFIA should be an objective of all stakeholders. In order to\nmaintain a good reputation, ensure that Namibia remains\nan investment place of choice and ensure that potential\nmoney launders are excluded from the financial system,\nfinancial institutions insist on KYC and AML\/CFT\/CPF\ncompliance.
